These terms apply when you request a quote from Cuztomi, place an order with us, or use cuztomi.com. Placing an order means you accept them.
"Cuztomi", "we", and "us" refer to Booey & Bros LLC, a Wyoming limited liability company, trading as Cuztomi, which operates its printing and fulfillment facility in Gilroy, California.
What we do
Cuztomi is a UV printing and fulfillment company. We print custom designs onto physical products using UV flatbed printers at our facility in Gilroy, California, and we ship those products to you or, where agreed, directly to your customers.
Quotes and orders
- Quotes are estimates based on the product, artwork, quantity, and timeline you describe. If any of those change, the quote may change.
- A quote is not a reservation of production capacity. Capacity is confirmed when an order is accepted.
- We may decline any order. Reasons include artwork we cannot print to a standard we are happy with, products outside what our equipment handles, timelines we cannot meet, and content we are not willing to print.
- Orders are accepted in writing. Until we accept in writing, no order exists.
Artwork and your responsibilities
- You confirm that you own the rights to the artwork you send us, or have permission to use it, and that printing it does not infringe anyone else's trademark, copyright, or other rights.
- You are responsible for the accuracy of what you send: spelling, names, dates, colors specified, and quantities.
- We review files before printing and will flag problems we notice, but a review is not a guarantee that we will catch every error in your artwork.
- You agree to indemnify us against claims arising from artwork you supplied.
Proofs and color
Where we provide a digital or physical proof, your approval of that proof is your approval to print, and we produce the order to match the approved proof rather than to match your original file.
We do not guarantee exact color matching, and we do not warrant that a printed item will match your design file, your screen, a printed sample from another supplier, or a previous run. This is not a limitation we are choosing, it is how printing works:
- Screens emit light and products reflect it, so a color on a monitor and the same color on an object are never identical. Screen calibration varies from device to device.
- Ink behaves differently on different materials. The same file printed on metal, leather, acrylic, and a golf ball will produce four different results, and the surface color and texture of the blank affects the outcome.
- Every printing machine and every process reproduces color differently. A result from a different printer, a different technology, or a different machine is not a standard we can be measured against.
- Batches of blank products vary. A change in the material we receive can shift how a print looks even when nothing on our side has changed.
- Some colors are outside what any printing process can reproduce, including bright neons and metallics, and specified values such as Pantone or hex references are treated as a target rather than a guarantee.
We aim for a close, commercially acceptable match and we will tell you when we think a design will not reproduce well. Reasonable variation in color, position, and finish is not a defect and is not grounds for a reprint or refund.
If color accuracy is critical to your project, order a physical sample before committing to a run. A sample is the only way to see the actual result on the actual material, and once you approve a sample it becomes the standard for that order. We strongly recommend this for brand colors and for any repeat or ongoing program.
Repeat orders
We keep your artwork so repeat orders start from the same file, but we do not guarantee that a later run will match an earlier one exactly. Blank stock, ink batches, and machine calibration change over time. Where consistency across runs matters, tell us up front and order in larger batches rather than in frequent small ones.
Turnaround and shipping
Turnaround depends on the size and complexity of the order, and any date we discuss is an estimate rather than a guarantee. We will tell you if a timeline is at risk. Once an order leaves our facility, delivery times are in the hands of the carrier and outside our control.
Payment
Unless agreed otherwise in writing, orders are paid before production begins. Prices exclude taxes and shipping unless stated. For ongoing fulfillment relationships, payment terms are set out separately in writing.
Custom and personalized products
Because every item we produce is made to your specification, orders cannot be cancelled or returned once production has started, and personalized items are not resellable. This does not affect your rights where an item is faulty.
If something is wrong
If an order arrives damaged, misprinted, or materially different from the approved proof, tell us within 14 days of delivery and send photographs of the items and the packaging. Where the fault is ours we will reprint the affected items or refund them, at our discretion.
The following are not defects: reasonable color variation as described above, variation between runs, errors present in the artwork you supplied and approved, and damage caused by the carrier after the order left our facility in good condition.
Our total liability for any order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses, including lost sales, lost profit, lost customers, missed events or deadlines, or the cost of sourcing elsewhere. Nothing in these terms limits liability that cannot be limited under California law.
Intellectual property
You keep all rights in your artwork. We keep all rights in our own website content, photographs, and processes. Nothing here transfers ownership either way.
Website content
Information on this site, including anything on our blog, is provided for general guidance. It is not a warranty about any specific job. Product photographs show examples of work and are not a promise of an exact result.
Changes
We may update these terms. The version that applies to your order is the version in effect when the order was accepted.
Governing law
Cuztomi is operated by a Wyoming limited liability company, but the work happens in California: our facility, our staff, and our production are all located in Gilroy, and that is where orders are made and shipped from.
These terms are governed by the laws of the State of California, without regard to conflict of law rules, and any dispute arising out of them or out of an order will be brought in the state or federal courts located in Santa Clara County, California. You and we both consent to the jurisdiction of those courts.
